A Lee County grand jury has indicted the Alabama fan accused of poisoning Auburn University's Toomer's Oaks sometime after the Iron Bowl.

OPELIKA, Ala. - Court documents show the grand jury indicted Harvey Updyke Jr. on two counts of first-degree criminal mischief, two counts of desecrating a venerated object and two counts of unlawful damage, vandalism or theft of property from a farm animal or crop facility.

Court records show Updyke will be arraigned May 26 before Lee County Circuit Court Judge Jacob A. Walker III in Opelika. He has a tentative trial date of June 20.

The 62-year-old Updyke, 62 waived his preliminary hearing during an April 20 court appearance in exchange for limited discovery from the district attorney's office. He is accused of poisoning the trees with a powerful herbicide.
